
Psychiatric Defense Evaluation
There are several legal constructs that, under some certain circumstances, impact upon the legal responsibility and culpability for defendants with mental illness who have engaged in criminal behavior. Such defenses are best understood as an “excuse” defense, rather than a “justification” defense and are primarily concerned with the defendant’s mental state at the time of the alleged offense. As such, they necessitate a comprehensive psychiatric assessment performed by a psychologist or a psychiatrist.
